Monitoring Counsel

Excess insurance carriers often retain us to monitor the defense of their insureds provided by another (primary) carrier. As monitoring counsel, we perform an independent review and analysis of the case, and provide our expert opinion of liability and damages exposure. Rather than taking an adversarial role, we attempt to work amicably with primary counsel. We participate at mediations, monitor depositions and trials, and recommend certain strategies to cut exposure. Our excess carriers are kept apprised of significant developments as they occur so they can adapt reserves as necessary.
